Utah Airguns Loyalty Program Terms and Conditions

The Utah Airguns Loyalty Program (the “Program”) is offered by Utah Airguns LLC (“Utah Airguns”, “we”, “us” or “our”) and is our way of rewarding you for doing what you already love: shopping the best in airguns, optics, and accessories. These Utah Airguns Loyalty Program Terms and Conditions (these “Terms”) govern the Program and your participation in the Program. 

By creating an account with Utah Airguns, or otherwise participating in the Program, you agree to be bound by these Terms, as well as our Privacy Notice and our Terms and Conditions (both of which are incorporated herein by this reference).

IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU MAY NOT PARTICIPATE IN THE PROGRAM.

Changes to the Program or Terms

We reserve the right to terminate, cancel, delete, modify, add, change or restrict all or any portion of the Program or these Terms, at any time, with or without notice, even if such terminations, cancellations, deletions, modifications, additions, changes or restrictions affect the value of Loyalty Points (as defined below) already accumulated or your ability to use such Loyalty Points.

Continued participation in the Program after any such terminations, cancellations, deletions, modifications, additions, changes or restrictions constitutes your acceptance of the Program and/or Terms then in effect.

Eligibility

You must be 18 years or older and a legal resident of the United States (including the District of Columbia and all U.S. territories and possessions) to participate in the Program. Participation in the Program is limited to individuals only – legal entities of any kind are not eligible to participate in the Program. Additionally, participation in the Program is limited to one account per individual email address.

We reserve the right to suspend, modify, or discontinue the eligibility of any individual who uses or is suspected of using the Program or Loyalty Points in a manner: (i) inconsistent with these Terms; (ii) in violation of any applicable federal or state laws, statutes, rules or ordinances; or (iii) that we determine is abusive or inappropriate in our sole discretion. In the event of such suspension, modification or discontinuation, you may lose some or all Loyalty Points accrued under the Program. In addition to the foregoing, we have the right to take appropriate administrative and/or legal action.

Certain products, promotions or limited-release items may be excluded from earning or redeeming Loyalty Points, as determined by Utah Airguns in its sole discretion.

Participating in the Program

The Program is a free loyalty program offered by Utah Airguns. By creating an account on the Utah Airguns website at https://utahairguns.com/ (the “Site”), you understand and agree that you will be automatically enrolled in the Program. You must maintain an account with Utah Airguns in order to receive and use Loyalty Points.

We reserve the right to close inactive accounts at any time in our sole discretion. An account is inactive if the account holder has not logged into the account, or redeemed Loyalty Points associated with the account, for a period of twelve (12) consecutive months.

You may cancel your account at any time by contacting us at (385) 685-5951. Upon cancellation, any unused Loyalty Points accrued in your account will be forfeited and cannot be redeemed.

Earning Loyalty Points

When you participate in the Program, you will earn one (1) loyalty point (each, a “Loyalty Point”) for every $1.00 spent on merchandise purchased from Utah Airguns. Only amounts paid for merchandise will earn Loyalty Points, and no Loyalty Points will be earned on taxes, shipping fees, gift cards, or similar costs or fees. Loyalty Points are automatically added to your account after a qualifying purchase is completed. Each Loyalty Point is valued at $0.01 and is redeemable only on the purchase of merchandise from Utah Airguns online or in-store.

In order to receive Loyalty Points, you must: (i) be logged into your account when making a purchase from Utah Airguns online through the Site, or (ii) provide your account information at checkout when shopping in-store. Any purchases made as a “guest”, or without providing your account information, will not earn Loyalty Points.

You can check the balance of your Loyalty Points when logged into your account on the Site or on the checkout screen while making an online purchase from Utah Airguns. It is your responsibility to ensure any Loyalty Points you earn under the Program are accrued correctly. If you believe there is an error in your Loyalty Points balance, or if you suspect your account has been the subject of any suspicious activity, please contact us at (385) 685-5951.

Redeeming Loyalty Points

When making a purchase from Utah Airguns (online or in-store), you will have the option to use some or all of your Loyalty Points accrued at such time (or you can save your Loyalty Points for a future purchase). If you use any Loyalty Points to make a purchase that is later returned, you will not be reimbursed for any Loyalty Points used, and Loyalty Points will not be added back to your account.

Loyalty Points cannot be redeemed for gift cards, gift certificates, store credit, sales tax, prior purchases, licenses or services including, but not limited to, shipping or extended warranties. Loyalty Points have no cash value and neither cash nor store credit will be paid for unused Loyalty Points. Loyalty Points are not transferable, and you can only redeem Loyalty Points associated with your account.

Expiration of Loyalty Points

We reserve the right to deem expired any Loyalty Points that have not been redeemed within one (1) year after the date upon which such Loyalty Points were accrued.

Change of Account Information

It is your responsibility to make sure the information in your account, including mailing address and e-mail address, is and remains accurate. Changes to your account information may be made by logging into your account via the Site or contacting us at (385) 685-5951.

Additional Terms

Loyalty Points may be subject to federal, state, or other taxes and such taxes are the sole responsibility of the respective participant in the Program. All interpretations of these Terms will be at the sole discretion of Utah Airguns and such interpretations are binding on participants in the Program. The laws of the State of Utah apply to the Program and these Terms without regard to any conflict of law rules that may require the application of the laws of another jurisdiction.

THE PROGRAM AND LOYALTY POINTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. UTAH AIRGUNS MAKES NO REPRESENTATIONS OR WARRANTIES (EXPRESS OR IMPLIED) AS TO ANY LOYALTY POINTS OR OTHER BENEFITS RECEIVED BY PARTICIPANTS IN THE PROGRAM AND EXPRESSLY DISCLAIMS ANY SUCH REPRESENTATIONS AND WARRANTIES. UTAH AIRGUNS WILL NOT BE LIABLE FOR INJURY, DAMAGE, LOSS OR EXPENSE RESULTING FROM THE USE OR ACCEPTANCE OF ANY PART OF THESE TERMS, THE PROGRAM, OR LOYALTY POINTS.

If in any particular state the Program or Utah Airguns has to apply for any special license, bonding, permit or other governmental regulatory approval, the Program will be void in that particular state. Participation in the Program is void if prohibited by law in the jurisdiction in which the prospective participant resides.
